These Terms of Service ("Terms") govern your access to and use of TripGuru, including the website, app, itinerary generation, chat, sharing, and collaboration features available at tripguru.app (the "Service").

By using TripGuru, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

TripGuru is a travel planning tool that helps users create, edit, save, and share trip itineraries. The Service may include AI-generated suggestions, public itinerary links, collaboration tools, and related planning features.

TripGuru is not a travel agency, tour operator, booking provider, transportation provider, insurance provider, or safety advisory service. We do not book travel or guarantee that any recommendation is accurate, available, safe, legal, or suitable for you.

2. Accounts and Eligibility

You may need an account to save trips, generate itineraries, use collaboration features, or access certain parts of the Service. You are responsible for maintaining the security of your account and for all activity under your account.

You must be at least 13 years old to use TripGuru. If you use the Service on behalf of another person or organization, you represent that you have authority to accept these Terms on their behalf.

3. Your Content

"Your Content" includes trip prompts, itineraries, destinations, dates, budgets, notes, chat messages, collaborator details, uploaded or entered information, and other content you submit to TripGuru.

You retain ownership of Your Content. You grant TripGuru a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, process, modify, transmit, and use Your Content as needed to operate, secure, improve, and provide the Service. This includes sending relevant content to service providers, such as AI providers, hosting providers, analytics providers, and database providers.

You are responsible for Your Content and must have the rights needed to submit it. Do not submit content that is illegal, harmful, infringing, invasive of privacy, or otherwise violates these Terms.

4. Public and Shared Itineraries

TripGuru lets you share itineraries with specific collaborators and may let you make itineraries public. If you make a trip public, anyone with access to the link may be able to view it. If you invite collaborators, they may be able to view or edit the trip depending on the permission you choose.

You are responsible for deciding what information to include in shared or public itineraries. Do not include private addresses, sensitive personal information, passport details, payment information, or other confidential information in a public itinerary.

5. AI-Generated Output

TripGuru uses AI to generate and revise travel plans. AI-generated output may be incomplete, outdated, inaccurate, unsafe, unavailable, or unsuitable for your circumstances. You should independently verify important details, including prices, hours, locations, transit schedules, visa requirements, safety conditions, accessibility, health requirements, and reservation availability.

You are responsible for decisions you make based on TripGuru output. The Service is a planning aid, not professional travel, legal, medical, safety, or financial advice.

TripGuru depends on third-party services, including authentication, hosting, database, analytics, monitoring, and AI providers. Their services may be subject to their own terms and privacy policies. We are not responsible for third-party services, websites, maps, bookings, restaurants, transportation providers, attractions, or other external resources referenced by TripGuru.

8. Changes to the Service

We may add, change, suspend, or discontinue any part of the Service at any time. We may also impose usage limits, modify features, or remove content if needed to operate the Service, protect users, comply with law, or enforce these Terms.

9. Termination

You may stop using TripGuru at any time. We may suspend or terminate your access if we believe you violated these Terms, created risk for TripGuru or others, or used the Service in a way that could harm the product or other users.

After termination, some provisions of these Terms will continue to apply, including sections about Your Content, disclaimers, limitation of liability, and disputes.

10. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, TripGuru disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability.

We do not guarantee that the Service will be uninterrupted, secure, error-free, or that itinerary suggestions will meet your needs.

11. Limitation of Liability

To the fullest extent permitted by law, TripGuru and its owners, operators, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, travel costs, booking losses, missed reservations, personal injury, property damage, or other losses arising from your use of or reliance on the Service.

To the fullest extent permitted by law, TripGuru's total liability for any claim related to the Service will not exceed the greater of (a) the amount you paid to TripGuru for the Service in the three months before the claim, or (b) USD $100.

You agree to defend, indemnify, and hold harmless TripGuru and its owners, operators, employees, contractors, and service providers from claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from your use of the Service, Your Content, your violation of these Terms, or your violation of law or third-party rights.

Our Privacy Policy explains how we collect, use, and share information. By using TripGuru, you agree that we may process information as described in the Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and may provide additional notice in the app or by email. Your continued use of TripGuru after changes become effective means you accept the updated Terms.

15. Governing Law

These Terms are governed by the laws of the United States and the laws of the state in which TripGuru is operated, without regard to conflict-of-law rules. Where required by law, you may have additional rights that cannot be limited by these Terms.
